The second appeal requested that all of the landward sand be eligible with the Applicants being responsible for the excess dredged sand. The PW closeout version and the first appeal response reduced the landward sand quantities to get to an eligible amount of sand replacement. The Applicant replaced 935,653 CY of sand with the excess coming from the landward sources. It was more effective to return this sand to the beach than to remove and dispose of it as debris. PW 792 was prepared to replace this sand with sand dredged from offshore, and sand recovered from public rights of way and private property, after it was agreed that removal of the landward sand was necessary as a health and safety hazard. Hurricane Katrina eroded 710,000 CY of sand from the engineered beaches in Gulf Shores.
